Smashed my truck up tonight

I was on my way home from work at 11:30 pm when a guy rolled through and ran a red light, I hit my brakes but my truck did not stop in time and i ended up hitting the back of his truck. I was in my 97 chevy 2500 6.5 and he was in an 04 gmc 2500 6.0 with dealer plates. I hit the rear quarter panel of his truck and it smashed the front drivers side of my truck. I went to move the truck and something up front was messed up as the truck kind of hopped out of the road. oil gushed everywhere. No one was hurt luckily.

The guy claimed the light was green for both of us and that it changed quickly even though there was a truck in front of me that had gone through the same green light, he pulled over then left even as I went to talk to him. I am not sure what will come of the police report I have never been in the situation before.

When they are assessing my truck is there anything special to look for? I know vehicles inside and out and I know every vehicle has it's own issues that need a close look after an accident. I do not want the truck totaled because I wont be able to replace it for the book value, but I need it to be safe.

Tyey have no right to total the truck. You have the right to turn the estimate amount into a check less deductable if you are at fault. if the other carrier pays the "total" is an a on issue. I went thru this ayear a go .My fault ,took the check ,found a lower price & I & my truck are happy.

The oil gushing was probably a split oil cooler line, it's located in such an area that an impact on the drivers side front (as you mention) would likely damage it. Be absolutely positively sure nobody starts the engine as the 6.5 will happily run without any oil in it...well, at least until it seizes up.

Bummer on the accident, bud. I was in a rear-ender myself a month or so back and the police never charged me because of the situation...there was an emergency vehicle also involved...long story.

I got rear ended yesterday night also. The poor lady ran into my trailer hitch and there was no damage to my truck except for a scratch on the stinger but it messed up her grill pretty good.

I had an identical thing happen a years ago in my wrangler no damage to mine messed up their grill.

I have to wait now and see who they try to put the blame on. I was not at fault but it is my word against his. The light was clear as day green for me, I had even double checked it right after I hit him. I spoke with a vp of a large insurance company tonight (his company is not involved any way he is just giving advice) and he eased my mind a bit.

I'm not sure if this will be applicable to your situation because of the traffic light, but I t-boned a car once that turned in front of me. I had no time to stop and hit her car towards the rear wheel. The insurance company claimed that due to where on the car that I hit her, I was partially at fault. Meaning that because I hit her towards the back of the car, I should have had ample time to stop/avoid the accident. I refused to accept that and after a month of fighting with them they called me and offered a payout of 90% of the damages to my car. I was tired of fighting so I accepted. I was unaware that by accepting the 90% pay, I was also "admitting" to 10% of the blame for the accident, which was complete b/s. Insurance companies will come at you sideways with crap like that so you always have to talk with your own insurance company before making any moves.

That is what I am afraid of is how far back on his truck I hit him if he floored his truck (no idea if he did or didn't) it would of caused me to hit him further back on the truck. We all know these trucks do not stop on a dime I have new (with in 3000 miles) front brakes on the truck and I had 500+ pounds in the bed extending my stopping distance. I slammed the brakes and downshifted to 4th and still could not stop in time.

Good luck! and don't let the ins. co. screw you. I had a girl turn in front of me a year ago, it totaled her car and did minor damage to my truck. She got charged and the ins. decided to not pay for anything. I was left out to dry and now she is sueing me for 25k for her pain and suffering! WTF!!

i would definitely talk to a lawyer about that bidge53, i didnt think that the ins co could refuse to pay on an accident? And if a person is changes lanes at all, they are supposed to be at fault, whether that means making a u turn, a lane change or turning a corner, they have to yield to oncoming traffic or traffic in that lane, this includes merging onto the interstate as well. My family has had this happen several times, and we were told by the police, and the ins co, if the person that is changing lanes does not yield they are at fault.

Again, it depends on where you hit them. If someone is merging with traffic or is changing lanes and you hit them in their bumper, they are technically in the lane and you are at fault.

There are none this is an old light. The vp of the insurance company I talked to gave me good advice and said he will help me if I need help. I did not talk to the other guys insurance company yesterday I should get to speak with them today.

Does anyone know the laws on dealer plates? I am trying to find out if he was even legally driving the truck with dealer plates on at 11:30pm. and if not what would that mean for me?

well in this day in age,

green = go
yellow = go faster

its total bs.

i hit a guy who stopped right in the middle of the road back in july. i was in my mom and dads 85 jeep CJ7. i know it was my fault but the kicker is that the guy didnt have any brake lights on or turn signal indicating which direction he was turning. now that we have that out of the way, any of you out there that have ever drove a CJ series jeep know what a ***** it is to turn the heat up and or down. i was in the process of turning the heater up ( and im not used to driving it, i was on my way to put a lift pump into the chev ) so im fiddleing with the heater and i keep looking up and this guy appears out of no where ( atleast i dont remember him in the road and ive got a pretty good memory) so i hit the brakes trying to turn out of the way of hitting him and i ram right up this guys ass. he's driving a 97 subaru, it totaled the subaru, the jeep had a bent front bumper ( piece of c-channel steel ) the steering wheel was bent because i had a hold of it and i wasnt letting go, and the center console came loose and knocked the t-case into neutral.

i told you that story to ask you this, do you personally think that if he had his foot on the brake that the car would have rolled 30-35 feet after i hit him at 27-30 mph in a jeep?

there is no law saying you need to be on your brakes while stopped, I do it all the time in my truck I will sit at a red light in neutral with my feet off the brake and clutch. he should of had a blinker on.

Also this guy was not racing through a red light a truck in front of me went through the same green light I went through this guy was just trying to get somewhere quick.

theres different laws pertaining to different situations, you were at an intersection with a light. this guy was stopped in the middle of an interstate highway... either way i was still at fault and we pulled the bumper straight again with the tractor and a chain.

this is true, if you hit them in the rear, whether it was your fault or not, i.e. they cut you off and slammed on their brakes, you are still technically at fault, unless you can prove they did it on purpose. But on the other hand if it is visible that they were changing lanes they are "supposed to" yield to traffic already there. but at the end of the day its all about what the police officer writes on report and who they give the ticket to.
