Insist on it. If she hit you that hard, and since its her fault, demand a new truck and all medical expenses. I'd also consult an attorney, not necessarily to sue, but to make absolutely certain you don't say the wrong thing (from a technical standpoint).

If her company balks, the fact that you've consulted/retained an attorney will probably bring them in line fast - especially since their cost will jump 30+% to pay the attorneys fees.

That sucks! Do yourself a favor if you haven't already...get in to see your doctor. Documentation is everything. Imagine if your condition worsens, even becomes permanent. Without records, you'll be screwed even worse! Don't hesitate to post some pics.

will it start? The tranny fluid is from a busted tranny cooler. Did the airbags deploy? Really sorry to hear that tho. :bawl: Hope you get a good shop to take care of it.

That sucks but.. as long as no one died all can be made well again. Just my 2cents , comes with having a teenage daughter, some other teenage boy just missed her a few weeks ago doing the same thing. Mine knows if I catch her on the cell she will loss the truck for a long time, and its a long walk to the friends house. As others have said, doctor and lawyer in that order.

Brother you hit the nail right on the head. Back in 2004 this story was posted on the Ford forum. It was the truck owner's wife who hit someone that ran the stop sign. She lived with minor injuries. The person that ran the stop sign was killed. My heart sank when I read that. His wife didn't take it too well, as anyone could understand. Having read that back then, I'm quite glad this thread is only about the demise of inanimate objects. The truck can be replaced one way or another. Regardless, both lives get to go on.

I have consulted legal advice not too hard, I know several sue happy a**orneys, LOL. I have also talked with the sister who is a doc, and she said MOST people with on-going injuries for auto-accidents are like me they were fine the night/day of and then they feel like a truck hit 'em (no punt intended).

Here are my thoughts, I have a source for GM employee pricing, get my rig fixed then sell it and get a new one anyway? I don't think I would take a hit too bad do you? I am also considering a 3500, dually this time for the GVWR, and ability to HOLD a REAL salt spreader. I've priced a new 2500HD as I have a 3500 and the 3500 seems to be cheaper.

What is the % off these days for GM employees, families?

All will be fine, lives can't be replaced, but trucks can!!

The whole thing SUCKS though!!!! My legal advice, will get me some money can't move for 3 days!

Man, I can feel for ya. My wife did the side of my truck in when it was 3 months old. It was replaced and looks great. Just hope you get to feeling OK. Don't sign off on anything until you consult the doc. I still hurt from the last rear ending I took.

Be sure to tell the insurance company you want compensation for 'loss of value'. Your truck is only a year old and was worth $xx,000 now after the wreck it will only be worth -$xx,000. They need to make up the difference or sue the difference from the driver. That might get you your new truck.

Some things to think about for your claim...
1. Is your state a "No Fault" State? if so your rights to demand may be limited
2. If your state is not a "No Fault" state, is this claim being handled with you as an claimant with her insurance company, or an insured with yours? If you are being processed as a claimant, then sock it to them and demand a new vehicle. It is your right as a claimant. If your are an insured, you must work within the guidlines of your policy.

Her insurance company will contact you fairly quickly and make you an offer - DON'T TAKE IT!

When you accept their check, that is the end of their obligation to you; whatever costs you incur after that time are all yours. See a doc to make sure you are okay, but you cannot begin to total your medical costs until the end of any therapy/medication/consultations. Perhaps spending a couple hundred for an hour or two with an attorney would give you a clear idea of what her insurance company needs to do to make this right for you.

On a side note - A new rule just came down fron the very top that no one on a government installation (such as my Air Force base) may drive and talk on a cell phone (hands-free devices are still approved for use while driving). It is now a primary offense, meaning you can be pulled over and ticketed just for that specific infraction. I hope every state adopts the federal government's stance in the near future.

If they do not give you a new truck you can sue them for a thing called "dimished value" ( I'm not a lawyer, nor am I giving legal advice)
Dimished value means even if the truck is fixed PERFECT ( ya right) it is still worth a whole lot less than a truck same year, same milage that has not been hit.

Get it inspected by their adjuster or yours. Get an estimate. Run it up on NADA.com to get approx value. The goodies won't add much in value but you're looking at what % the damage is versus the value. If the damage is 25-50% of the ACV of the truck, it'll probably get fixed. 50-66%. It's borderline, 75% or more, it should total. IF it totals, ask how they will evaluate it, if it's ADP or CCC, ask to see the markey survey, it's about a 5-10 page form where they found comparable vehicles. If it's "local market survey" you need to do your homework, to put a value on the vehicle for "comparable" vehicles.

You can include loss of use, if you plow, haul firewood, etc. Loss of Value depends on your state laws, but you have to prove what you've used it for.

YOu can't automatically get a new truck and here's why. If your truck is worth 40K and you're not injured, an attorney has no money to go after to collect his 33%. He only has $40K to work with and if he takes his cut, you won't have enough to buy an 01. If you're injured, that's different, you can have a bodily injury claim for "pain" med bills, lost work, etc. while you're out.

I'd also find out if she has minimum state limits on liability. A lot of young drivers have 25K total minimum liability limits, and if you're truck is worth more than that, you will need to file through your own company as she won't have enough money to get you paid back. If she does have that, most adjusters will tell you straight out, because they don't have any incentive to hide the fact they don't have enough money to pay for the truck, let alone an injury.

You may also have coverage for "Underinsured" motorist on your insurance policy, for cases just like the above. This pays and sometimes the deductible is less, than your regular collision deductible.

I have to warn you up front, most mods don't add ANY value to your truck. Lift kits, 33" wheel/tires, 2K stereos might add $500-1,000 TOTAL. If they are mods you can remove like like bar, tool box, take them off, if you're going DMax again, as you'll save in the long run. Check NADA.com to see what bedliners, etc ad for value

A quick way to see how hard you got hit, is ask if the uniside needs replaced. That's the framing member that surrounds your doors. If they hit you low, they can section in the rocker area. If you need it all replaced, you got a pretty good lick.

I got hit awhile back by a drunk driver that was 3 time over the legal limit. He has/had no insurance. I only owned the truck a total of 26 days when he hit me. My insurance has been really good to me so far. The truck has been fixed and they are taking care of the medical expenses. As far as the drunk he pleaded guilty and is on probation and was ordered to pay restitution to me but I havent seen a dime.

A good point was brought up about warranty. Have it fixed at a dealer. Then if they claim it is from the wreck...tell them their body shop fixed and it is their dealerships problem either way.

Very good points in your post. By all means, carry the "underinsured motorist" insurance. I dropped mine when my boys were teenagers, trying to cut insurance costs, and it happened. My wife was run over (in truck) by a driver with minimum coverage. A couple years later, we finally recovered enough to cover her medical expenses, but it would have been much better with the extra coverage.

Do yourself a favor and go get THE best lawyer around pay the extra money for him and sit back. My last accident an older man pulled out into a 5 lane road from a parking lot right in front of me. I hit him between the tires, but because he had this great attourney they changed it all around to were my attourney quit me and I am still holding medical bills from the accident. Didn't get any lost wages and 1 year later I'm having more problems flare up. Go to a doctor then go to a chiropractor but have that lawyer under your belt asap.:rant:

I KNEW I SHOULD OF NOT READ THIS THREAD! My truck has 1,100 mi on her. Now everytime I drive it I'm PARINOID (spelling?)

My 16yo daughter hit a parked car due to talking on a cell phone on her BIRTHDAY!! Just a fender bender but she cryed for a week!! felt bad for months!! remember the girl wrecked HER car as well. Believe me she's paying.
My daughter is 19 now and is reminded every B-day

I know one thing, when you pick up the truck after the repairs, do not sign the release under after you drive it and go through it with a fine toothed comb.

Not exactly a realistic test... they forced the drivers to execute complex maneuvers WHILE engaging in a conversation that required deep thought/full concentration.

In reality, you can hang up or ask the caller to hold on while doing something... you can't do that when you're drunk.

Back when I smoked, I had WAY more close calls lighting one up than I've ever had while on the phone... and I'm on the 2100 minute plan and use damn near every one of them... been that way for nearly 10 years.
Two accidents, one my fault, phone wasn't even in the truck either time.

If you dont want your truck back, take everything out of it that did not come with it, and insist on having it totalled, even if you go through your insurance company.

Get your own estimate from your own body shop, don't trust your insurance company's estimate either, they will always try and pay for less.
