: Lemon Law in Texas?

Has anyone ever had to use the Lemon Law with GM. I have had an oil leak on my new 2010 Dually since it was new. They tried to fix it at least 3 times and then GM finally put in a new motor at 12000 miles. Well at 33,000 the new motor is leaking and it appears to be in the same location. The old cause was a pin hole in the cast. I'm done with this and was curious how to approach it. Thanks.

I did back in 1987 with a ford mustang gt. Was a real pain in the butt. I ended up walking out on the arbitration board and went to the gm at the dealership and finally got to talk t the owner and the very next day the owner called me back and gave me 2 choices. 1 bring them the car and they would refund all my money or they would apply that money to anything on the lot, at dealer invoice.

The whole process took about 6 months and was a total pain in the butt. If you have the patience and time to deal with it, go for it.
I would try talking to the owner of the dealership first.

Thanks. That's what point I am at now. Dropped off truck at dealer today and they wanted to see where it was leaking from. They understand my frustration. They mentioned one thing that may happen is they might be able to give above trade in value and then dealer invoice of a new one. We will see where this goes. I see what your saying about this having the potential of being a huge pain.

Lemon law is pretty much worthless...the key phrase is that the "same deffect must seriosly affect the use,vallue,or safety of the vehicle."

That can be interpreted many ways...usually your best course is a trade-assist from Gm....good luck.

Spoke with the dealer again today. They are going to contact GM and work on getting me trade assist and put me in a new truck. I will keep you posted.

Friend of mine had a problem, and filed a complaint with the BBB, that got action and a new truck!

Update. Blue book on my truck is $43,000. They are offering me $37,000 on trade in. They get this because GM is offering a $5000 rebate on the 2010 diesel (43,000-5000 =37,000).
Now at this point GM is offering $2000 in trade assistance so bringing the total to $39,000 for trade. Does anyone know if that's right? Doesn't seem fair that I have to eat the $5000 rebate too.

your truck has 55,000 miles,right?...so for 4k your getting the same truck with 0 miles and a fresh warranty?...sounds good to me

My 2010 truck has 33,000 miles on it. They are wanting to put me in a 2011 same features for around $51,000. I would then be in a new truck out 12K for a new truck ($51,000-$39,000trade). If it was 4k then I agree with you. I would do that deal and think it was fare.

If you want to know what the Auction value is I can pm you a number for a good friend who can tell you that and what the real street value is. I used edmunds dot com to price my last 2 trucks, to get the actual invoice price and it was within 150.00 of actual invoice price. Try that on the 2011 they want to sell you. Do your homework and go back at them with some better numbers. Even at invoice price there is at least 1500. In rebate money to the dealer. They can sell you one at real invoice price and still make money. Does not sound to me like they are making you that great of a deal, especially after all the bs you have had to deal with.

I agree! I'm getting the run around. I went to another dealer and can get the exact same truck for the same deal with no assistance from GM. The new dealer is offering me 40,500 for my trade. Something tells me that my dealer is just telling me that GM is gonna give me 2k and making it look like they are helping. They are just playing with the numbers, and it doesnt matter which dealer I buy it from it will cost me the same today if i pulled the trigger. I'm having the other dealer call GM tomorrow and see if there is even a case open on my truck. They said if GM is offer trade in assistance they can add that to my new purchase saving me more. I have the feeling that there isn't. If thats the case heads are gonna roll and i will do whatever I can to discourage people from buy from this dealership.

I fought GM back in 1994 over a Safari Van that had a horrible vibration from the minute we drove it off the lot. They had it more than we did in the first 3 months of ownership...filed thru the Maryland State Lemon law for arbitration and stood our ground. They knew they had no case cause they couldn't find the problem, and therefore, couldn't fix it.

Four days prior to the arbitration hearing, they bought the truck back for $1,800 MORE than we paid for it and found us a new vehicle. The one big difference is we didn't have 1,500 miles on the truck...

The key is to stand your ground and take it all the way to arbitration if necessary. They bank on the fact that most people give up and trade out of it...we didn't, and they knew we would win...Good Luck!
