Alright, the deal is I'm trading a guy my single wheel gooseneck trailer (25') which is registered as a farm trailer for his 25' dual wheel gooseneck trailer. His trailer is registered as a commercial trailer. He says he has a clear title and so do I. Is it as simple as going get tags and registering it under my name? Do I have to pay taxes on it since it's a even trade and no money is exchanged? I am located in Texas. THANKS in advance

The tags change with ownership, so even if it was licensed with commercial tags for him, you should be able to get farm tags on it for you.

Taxes may be a little more complex. While you may not have actually exchanged any cash, you did purchase the new trailer with something of value (your old trailer). Sometimes you can get away with the "One dollar and other considerations", sometimes you can put a very low but possible price on the exchange (like $300) but both of those really depend on how the people in your license office are in your area.

Can't speak for Texas, but around here although they use book value for tax purposes on vehicle transfers (with few exceptions, although there is the $1 "family or gift" allowance), for trailers they have no values recorded so they go by whatever the bill of sale shows.

I think you may get the fuzzy eyeball showing "$1" or something for the sale, but I'd both go at the same time, explain the situation, and see what the DMV will do for you.

You may have to get a sworn statement or something for the DMV to allow the no-value-transfer, but that's no biggie...certainly whatever that may cost will be less then the alternative taxes payable otherwise.

Can't speak for Texas, but I just did a trailer even trade here in MO today. MO has a bill of sale/even trade form. All I had to do was fill in the traded section of the form showing what trailer I gave up in exchange for his trailer. No taxes were involved only the usual other rip off fees.
