I traded my 2001 F350 powerstroke in on an 05 D/A 2 weeks ago today. Lastnight the dealer called me and said they had it financed but there was a high payoff on my Ford and they need $633 from me. I told them no way im not giving them another dime since I already put 3k down payment on it. They said ok we will see what we can do. Another guy called me today and said they will split it with me. I told them go to hell I am not giving you another dime. I told them they can have the truck back and I will pick mine up if they want and he had no answer to that. He said "well you got a duramax" I told him that my 46,000 mile powerstroke was perfectly good truck and I dont mind taking it back. Still no response to that. This was at about 9am this morning and I still havent heard back from them. I have no problem paying the $600 if it was my responsibility but they called for payoff the day we did the deal and it was what is stated on the contract. Its not my fault they were overloaded with other deals and waited till another payment came due on the truck and they want me to pay for it. I told them that also and he didnt have anything to say about it. I am mostly angry at the fact that I took less for my trade in than we initially talked about because I wanted the truck but now they are pissing me off by asking for more money.

I would really appreciate some opinions on this. Am I totally wrong and I should pay the money or is it their problem? Also, if the deal is done on the contract then can they actually demand for me to return the truck or is a deal a deal after its on paper? Please help. Id hate to get rid of this thing but I dont want to get screwed either.

Dave - You signed all of the paperwork when you traded I'm assuming...
As long as you have a copy of this, I don't think they have a leg to stand on..
Personally, I'd do what you did and tell them to go piss up a rope.

Tell them to go Censored themselves. They agreed with the contract just like you did. I mean come on it's only $633.00.

The only thing that I see that may give them any leverage is on the Down payment part of the contract it shows my truck being traded in and list the payoff amount and it says "Estimated" next to it. I dont see anywhere on the contract that says if it was more than the estimate that I have to pay more. The finance manager didnt mention it either when we signed the paperwork.

You traded (signed the new contract) before the next payment was due, they Payed of the old contract after the due date, the principal on the note would be the same, additional interest would be the Only difference. If $633.00 was your old monthly payment the new payoff will Not be $633.00 more and totaly their problem.

If your old contract was based on the Rule of 78, the amount of principal payed in the first 30% of the contract is nearly zero.

My old payment was $626.49. I guess the only thing they could say is they couldnt get my financing approved and I need to bring the truck back. Even though they called me yesterday and said it was approved by the bank but they wanted me to pay the extra money. The finance manager tried getting me to give them the ok to add it into the contract as part of the total financed. He said it was up to me to pay the amount due. I told them no way in hell and that is what led up to my first post. What a miserable experience.

dave, most states i have lived in have 3 work day process period to verify info. they knew what you owed when they where selling it to you, stick with your signed contract i think they are bonus fishing. might want to check state consumer laws or consult lawyer, so you know your rights. you might even get them on harasment if it gets to it.

Who is this dealer? :confused: I see that you're located in the Sacramento Valley area. I am in process of buying a new gasser from one of the Sacramento dealers. Want to make sure that I get a heads up on these guys. Thanks. :ro)

dave, most states i have lived in have 3 work day process period to verify info. they knew what you owed when they where selling it to you, stick with your signed contract i think they are bonus fishing. might want to check state consumer laws or consult lawyer, so you know your rights. you might even get them on harasment if it gets to it.

I think Keith is correct. I'd stick to my guns if I were you, and DO NOT let them tack the difference on to the contract, If you decide to pay it, pay it out front, It'll be cheaper in the long run. Good luck

Would they give you the extra money if 2 weeks after you traded, you found a dealer that would give you that amount on your trade? A signed contract should be all you need. If all else fails, call GM and complain about the dealer's tactics.

Hey,Dave here a possibilty did you have a payment in the mail. Maybe it did not post yet? Did you verify the payoff at the dealership? Just the fact they are willing to split difference they probaly screwed up.If they were right they would want the whole amount.

Legitmate or not, take the Dmax to the dealer, ask to see the manager. Tell him how upsetting it is to be harrassed by this bad deal and ask for your old truck back. There are only two acceptable solutions:

Get your truck back and buy a Dmax somewhere else. (being a little smarter this time)

Get a reciept that the deal is complete and paid in full AS IS. Nothing additional owed.

Personally, I would give em the truck back and run away to another dealer. IF they insist you owe the money, then the deal is not complete and you have the right to get your truck back.

The dealer can't take the truck back. It has been registered so they can't sell it as new. They would take a bath on the re-sale. They are stuck there. You signed a contract, they signed the contract, stick to your position of no more money.

The line was she was auditing the sale and a mistake was made on a discount and I owe additional money. I told her I signed a contract, they signed a contract, deal done. No more calls.

One other thing. In the state of Kalifornia, once you sign the contract that is it, deal done. No 3 day cooling off, nothing. Bull on the esitmated payoff, they knew the payoff before they cut the contract. So if they keep bugging you just tell them to take you to court and we will settle it there.

That's exactly right. Dave, I hope you can identify the common elements of your deal and Jim's deal. It's the same story - you should take the same action.

I say you take the truck back. Then take a short trip north to OR. and not pay sales tax :ro). With the employee discount and no taxes it could make for a sweet deal.

Well, they still havent called back. I guess they got the hint or are trying to figure out something else to screw me on. Maybe they arent used to people telling them to go to hell. I would guess that a lot of people that really want that new car would go for it but like I said, my powerstroke was just fine. Not the cadillac that the silverado is but served its purpose just fine. Id be more than happy to take this truck back and shove up their ass but most likely they dont want it back and just want my money. Who knows.

Your doing exactly what you should be doing...If the paperwork is signed and your in possession of the truck, it's yours...Tell them to shove it where the sun don't shine...They've already copped to 1/2 of what they were asking for..Ask them if they've ever heard of the "internet", where you'll slam them and there dealership every chance you get and tell everyone you know, every chance you get, what a "rip-off" place they have...Again, IF you have possession of the vehicle, signed paperwork, with a monthly payment and date payment is due..you got them right where you want them...They'll sell your trade-in for more then they gave you for it...enjoy the Duramax..run a bluff, if it get's ugly, tell them your lawyer will be contacting them very shortly.

Well, everything worked out with no lawyer needed. They never called me so I called them and was told "we took care of it, enjoy your new truck". So anyone looking to buy a new vehicle in the northern california area Id be careful with John L. Sullivan Chevrolet in the roseville automall. I sure am happy I didnt fall for their trick and saved myself almost enough for a programmer. :)

Thanks again for everyones help. Its places like this that make a $56 dollar per month internet bill worth every dime. Now if the rest of my parts would show up I would be even more happy.

Glad it worked out for you, you can bet those maggot sucking bottom feeders made money all the way around..think about it, they knocked 10,500 off my sig. vehicle, gave me high book on my 2003, knowing full good and well they still made money on the 2005 and will sell my truck for more then they gave me for it, though that may be hard to do...I believe I'll stay with the place I purchased mine from, I'd never even purchased a vehicle from them before..Enjoy your new truck man, just like Christmas, ain't it.
