Depth of filter in deep pan.

I have a Mag Hytec pan and filter. I noticed when I had the pan down tonight that the filter has a crack on the top side.

Does the filter sit low enough in the fluid to have the top covered and prevent losing prime?

After the fact I think I could use this filter lock I have been reading about here.
