: chevy voided my warr.
kfowler05 01-20-2005, 04:27 PM I just took my truck into the dealership and left my banks six gun adjustment knob in the console and they called me and said it voided my warr. I unhooked the battery a week before i took it in and they said the computer brought up troulble codes caused by my tuner. I was wondering what i do in this situation, do i fight it or is it a lost cause?
snowsdog 01-20-2005, 04:37 PM Was the six gun still hooked up or did you remove it prior to taking it in? If they are saying that based on a knob, I would fight it.
Good Luck

I unhooked the battery a week before i took it in and they said the computer brought up troulble codes caused by my tuner. I was wondering what i do in this situation, do i fight it or is it a lost cause? We could check your vin to see if a warranty block has been put on. If not I would go to another dealer and never go back there. If it has been blocked I would call customer service and complain.
Max Power 01-20-2005, 04:41 PM What did you bring your truck in for?
Max Power 01-20-2005, 04:44 PM Under the Federal Magnuson-Moss Warranty Act of the United States Code Annotated Title 15 Commerce and Trade Chapter 50 Consumer Product Warranties Section 2302(c), and the general principles of the Federal Trade Commission Act, a vehicle manufacturer or dealer may not make its vehicle warranty conditional on the use of any after market system unless the manufacturer provides the system free of charge or the Federal Trade Commission (FTC) has given the warrantor a waiver for this section of the law or specifically published that only the vehicle manufacturer’s product may be used.
In laymen terms, this means that NO vehicle manufacturer or dealer may make conditional its warranty because you installed an aftermarket product on the vehicle. The Federal Trade Commission (202-326-3128) administers the Magnusson-Moss Warranty Act and monitors compliance with warranty law. The Magnusson-Moss Warranty Act is viable all States regardless, however some states may have additional consumer protect laws, please consult you local consumer protect offices for more details. To obtain a copy of the Magnusson-Moss Warranty Act please click HERE (http://www.astroflex.com/modules/AxialRealisation/img_repository/files/documents/Magnuson-Moss_FTC_Warranty_Act_B.pdf).
Horse Trainer 01-20-2005, 05:43 PM MP has it. All a manufacturer can do is to deny a warranty claim IF the product is deemed to have caused the problem. While the burden of proof is on the dealer/mfg, M-M does not make it as easy for the consumer to win as it might sound (although they do all the time). I believe that the only way a mfg could void your warranty would be if it specifically states in your warranty book that they may do so if you make certain modifications, or you have signed an addendum to that book that so states. The techs might have another take on this from the real world side. Sounds like someone was being a jerk. And yes, your state might have even stiffer Fair Trade Acts that go beyond M-M.
firstruck 01-20-2005, 05:48 PM Gawd, great technical advice and now free legal advice as well, this board just keeps gett'in better everyday! Ya know just the other day I spilled some hot coffee from the drive thru on my......
Wouldn't they have to refund your warranty costs that are built into the vehicle?
If you get a Dodge you don't have to worry about them voiding your warranty.
Mackin 01-20-2005, 06:08 PM If you get a Dodge you don't have to worry about them voiding your warranty.
Hows that? I can recall a "warranty voiding "tape on Pre Common Rails.Chrysler looks the other way, now,Eh
Got Juice? 01-20-2005, 06:37 PM If you get a Dodge you don't have to worry about them voiding your warranty.
SHULLBIT!
The reason i am driving a GMC is from my Last 3 DC Vehicles, Specifically My 2001.5 CTD
3 Lift Pumps, 5 Track Bars, 25 ball joints... added a DSS and Moog Track bar this time, 1 VP44, 1 more lift pump, 1 turbo, 1 NV5600 Transmission and 3 clutches... all of this on an UNBOMBED CTD with 135,K Miles.
Chrysler said FU on the turbo, the VP44, 1 of the lift pumps, and 2 total front ends.. and the old TSB of the coild spring mount welding had to be done on this truck.
As the old joke goes..."Don't eat that ELMER .. it's HORSESHI7!"
After 10 years and 800,000.00 in vehicles You would think my business and my companies would mean something to them.... Guess not. So I decided to vote with my $$$ this time (instead of the legal action) and Buy from GM.
Ya, GM ain't perfect, but they treat me like I treat my own clients.... with respect, and an open mind.
NUFF SAID!
bob camire 01-20-2005, 06:55 PM Got Juice..nice post, thanks for reminding me i made the right choice, bc
Wow Juice
You must of tightened the grips to tight on there cahoneys.
Hows that? I can recall a "warranty voiding "tape on Pre Common Rails.Chrysler looks the other way, now,Eh
):h ):h ):h
I don't have to worry about voiding my warranty because it ain't worth anything to start with. Gotcha
I haven't been in for anything in a long while but the experiences I had were not promising.
Juice your story doesn't bode well for Dodge trucks but there are a whole lot of super high mileage wonders out there that blow most anything GM can put together.
The latest third Gen DOdge has many of the same components as the GM you drive now. Plus a decent 6 banger. Little engine that could , can and will. Dmaxes are fun but they ain't unbreakable. The new Dodge is quite a bit better than anything before (Dodge) overall my research has shown.
GM service is first class in my experience. I love the dealer we bought my wifes Rainier at. It was in for a few normal tweeks and they go out of their way for us. Dodge service sucks so far.

GMC-2002-Dmax 01-20-2005, 10:37 PM I just took my truck into the dealership and left my banks six gun adjustment knob in the console and they called me and said it voided my warr. I unhooked the battery a week before i took it in and they said the computer brought up troulble codes caused by my tuner. My dealer never says SQUAT to me..........
I have knobs, switches, gauges, 4" dual exhaust, liftpump, Nicktane, AFE Intake......oversize tires, etc...........
I don't even get a question, nor an iquiry about anything.........it was just back in to the dealer for a block heater and the Service Manager said the tech liked the CAT Filter and taigate straps I have.
My reply, THANKS.............I'll be giving you guys all Excellent feedback on the GM survey........;)
FInd a new dealer and fast...........
Does the knob say BANKS on it or is it just a knob ???????
T:eek: NY
Max Power 01-20-2005, 10:42 PM It looks like it says 'banks six gun' on it. A really dumb move on banks part if you ask me.

Got Juice? 01-20-2005, 10:47 PM Hoot, the truck was a 2001.5..... and cost me more $$$$ in warranty than my GMC ever did. The NWBombers know this well.
If any Vendor, or company busted your balls like that would you buy from them again?
If so , give your head a shake.
I concede that the new 3G ram is better.... for the long haul i know the motor is fine, but it takes more than 1 singular component to sway me now..... I bought into the CTD legend and Mystique.... I got let down, and there are Horror stories from all makes. BUR my friends CTD (A Bomber) does not tow... has 1 box, been thru a full front end of balljoints, 1 RPS (consumable i know just like a DMX) , 2 injectors (Same said as per DMX) and has had a few other issues, like knocking of engine, poorer mileage than me (where is the CTD chant now of better mileage?)
So FWIW I made my choice, spent my money and although i miss the ground clrearance a bit.... and the RAM TOUGH looks, I have a reliable vehicle to make my living with. Beauty is only skin deep.... Beware of the rest of the Btch though!
DC you listening?
Oh, and if you really want, i can provide the VIN#..... Yes, i am quite finished with dodge..... for now
GMC2500HD 01-20-2005, 11:01 PM I would personally fight it, but you have to have a very compelling argument as to why what you have done to the truck would not void the warranty. And then as Max Power pointed out there is the MM Act. Which should be on your side. Good luck...
GMC-2002-Dmax 01-20-2005, 11:14 PM It looks like it says 'banks six gun' on it. A really dumb move on banks part if you ask me.

Yup..............mine say nothing...........
_nar_ 01-21-2005, 12:03 AM Another thing: When you say in the console, you mean laying out where they could see it or did they open it and dig around? If they dug through your junk I'd be pretty pissed about that... They have no right to go hunting through your stuff to see what you have. Lucky you didn't have any spare cash laying in there.
CalDirt 01-21-2005, 12:28 AM .....I'll be giving you guys all Excellent feedback on the GM survey
THat's a good point - work the power of the survey. The guys at the stealership really seem to be motivated by it - especially the service manager.
Maybe it was just my dealership but I had some issues, started to make a stink and the service manager just took care of business. Above and beyond what I'd expect him to do just because he cared - he was clearly motivated by getting high marks.
So maybe there are some dealers that have had bad marks, lost their car allotments and now the pressure is on the service manager to make HAPPY customers. If there's a way to find those dealers, maybe going to them and working the survey for all it's worth is the key to getting them to just do right by you (as they should to begin with!).
Mabe there's no survey because they voided your warranty but maybe you can ask for a survey, or take another GM in for service and then SLAM then and let the service manager know it's coming. it's some leverage you have short of hassling with our legal system.
motovet 01-21-2005, 12:57 AM So the truck went in for.....?
Mackin 01-21-2005, 05:42 AM First off the dealer can't void your warranty,But GM can. They CAN refuse to service your vehicle for fear on non warranty payment.
Remove the stupid switch and go some where else.
DuramaxEric 01-21-2005, 07:43 AM Max Power is Right on.. the same goes for air, fuel, and oil filters too. They can't void your warranty because you put a K&N in !
03 Radio Flyer 01-21-2005, 11:19 AM I'd say "I just got the knob on e-bay, to impress my friends", and its up to them to prove otherwise. Void this, A$$wipes!!!
If it was hidden from view, and the service they were doing did not require them to access the place where the knob is mounted, that is called "Unlawful Search"..... Time to call one of those TV Sheisters and see if you can get your truck, hour house, and a 3-week vacation in Hawaii paid for in six weeks.....
akdiesel 01-21-2005, 12:31 PM I took my truck in to the dealer a few months back to get my Steering shaft greased and after the third attempt they said they would honor the warrenty work to do it since they thought it was the tie rods and that I also cranked the t-bars.
After a lengthy talk with the service manager he mentioned that if the we take this into the Magnuson Act rulling there will be investigation and if I do loose due to the cranking of the t-bars that my truck will have a black mark against it and any and all warrenty work will be voided from that moment on.
I felt like my hands were tied. But after talking some more we came to an agreement and discussed what I thought the problems was and they finally greased the shaft and (not to rub it in or anything) the problem was fixxed.
I am a true believer in the Magnuson act, but I did not want to have the GM Rep nosing around my truck looking for any excuse to void anything.
The Service manager seemed to be putting his companies interest before mine, but we finally came to a settlement. I have to drive over 400 miles round trip to see another GMC dealer to get a second opinion.
This game can be a role of the dice. If you play hardball with them they have very little to loose like a bad survey. You on the other hand stand to loose much more if you are denied.
I guess what I am saying is talk to the service manager with respect as long as he does the same, go in with any and all paperwork to prove your point, remove anything you might have concerns about, and if at all possible get in bed with the service manager. With anyluck she might be good looking.
Don't take offense to that statement, women drivers.
jmg343 01-21-2005, 12:55 PM just a quick funny note...i bought my truck and was taken, hook line and sinker. I realize this after it was too late but hindsight is 20 20. Went back to dealer for first service, I always let them do the first and i do them from then on. Salesman told me to fill out a survey and in return id get a free tank of fuel. I filled out the survey, honestly. He said no free tank of fuel unless survery was filled out with everything marked "totally satisfied" or whatever the highest mark was. I LOST IT! Told him he could keep his damn fuel and that i wasnt gonna lie and say he did a great job when i though he was a snake. He cowered, apologized, and gave me my tank of fuel. Shot....score.
kfowler05 01-22-2005, 12:31 AM My truck would only run at half power, and i found out that my glow plugs and 3 out of the 8 injectors are cracked. They are blaming my six gun for that and it has nothing at all to do with the glow plugs, i'm not to sure about the injectors. And yes they dug around my console to find the switch cause it is on the bottom of my console and it was filled wit papers and all kinds of sh*t. The main reason they said I had a chip was because I had the "banks power decal on the side" and that is a quote from my bill I received from them. We are still fighting with them because we have a 03 ford dodge and chevy and my chevy has been in the shop 4 times and the ford and dodge 0. Its kinda pissing my off since they wont back up there product, especially since injectors in the duramax's are having trouble. Thanks alot guys and i'll get my vin number so it can be ran to see if they blocked the title.

Something just isn't right.
Dealers don't have ANY reason to LOOK for anything, and don't.A technician isn't going to rumble through your stuff run up to the service manager and say look what I found!
By now EVER dealer in the USA and Canada are aware of the injector "potential" problem, the blame game is over.
I hope you give up the Vin because right now,I'm having a hard time buying the story as told, something is obscured
BIGBLOCKBILL 01-22-2005, 09:05 AM Sorry to hear about your stealer troubles KFOWLER05. I also have been "run off" by the local dealer. I went in for a speedometer recalibration and didn't even make it through the door let alone get my truck worked on. I was greeted by the service manager, head mechanic, and another mechanic at the front desk. They basically told me I had no drivetrain warranty due to my larger tires. All this and I had the truck there for a service I was going to pay for,not even warranty issues. I called the dealer I bought it from in NC,very cool people. They said I still had a full warranty with them and would not void it for anything. I wish I lived closer to NC,8 hours is a bit of a hop for warranty work.

kfowler05 01-22-2005, 12:59 PM vin # 1GCHK29183E341805, check it if someone can, i'm interested in seeing what it said. This isnt the first time I have had a problem with the dealership, when it was getting a new transmission it got broken into on their lot when it was supposed to be inside because I have a tool box full of snap on tools and the busted my widow and took my radar, cell phone, and my digital camera. Wouldnt pay for it and just replaced the window. The reason they went through my console was because I had a banks power sticker on the side of my truck, so when they found the knob they called me and said I had a programmer and they voided my warrant.

Loki_nine 01-22-2005, 01:43 PM - it got broken into on their lot when it was supposed to be inside - busted my widow and took my radar, cell phone, and my digital camera. Wouldnt pay for it and just replaced the window. MO is a "Bailee" state.
This in simple terms means, if a party/bailee (the dealership in your case) accepts possesion of something, the party/bailee also accepts responsibilty for it - regardless of what is stated, posted, or signed off on. (ie-two parties cannot mutually agree to voilate the law)
Resturant coat checks are huge violators of this & lose every time they wind up in court.
However, these laws apply to all. (the case law cited below involved a dealership)
See print below, this is from your state. Then get a lawyer & get reimbused for your property that went missing while in anothers care.
A legal bailment is defined as "a contract resulting from the delivery of a thing by the bailor to the bailee on condition that it be restored to the bailor in accordance with his directions as soon as the purpose for which it was bailed is satisfied." v. McCaughen & Burr, Inc., 839 S.W.2d 322, 326 (App. 1992). The bailee has the duty to exercise ordinary care with respect to the bailed article. The bailee's exercise of ordinary care is an issue of fact rather than of law.
Upon proof of loss, a bailors allegation that damage occurred due to failure of bailee to use reasonable care raises an inference of negligence under the doctrine of res ipsa loquitur, thereby shifting the burden to bailee to go forward with evidence of due care. Kinder v. Fantasy Coachworks, Ltd., 762 S.W.2d 533, 534 (App. 1988).
kfowler05 01-22-2005, 02:50 PM Thanks a lot guys i'm gonna get it to a diff dealer on monday. But if my warranty isnt voided how does the main branch of chevy know about it cause we had to call them and they said it was voided? Or is the dealership just feeding my bs again?

I had the same problem with Landmark Dodge hear here. Would not pay me a penney to fix my window or the items stolen from my former Dodge vehicle a few years ago. Lost my business forever. I will remember this post if it ever happens again.

KFowler05,
Heartland Chervrolet is just a few miles south of me. If that is the dealership giving you trouble, I am glad I decided to buy mine through Crossroads Chervrolet in Kearney. I had narrowed my choices to these two before I decided on Crossroads. They took the deal I wanted and and I dealt directly with the General Manager because I ordered it at invoice. Plus, Heartland has that "slimy" dealership feeling. If you have not tried Crossroads, I would go there. They are a small dealership, but so far, the service has been great and the manager and service manager know all about my 265's I had put on when the truck was delivered. We talked about warranty issues with the bigger tires and they said it would not ever be a problem with them if a problem ever developed. In fact, they put them on when the truck was delivered.
kfowler05 01-22-2005, 04:20 PM When I buy my new truck I will deff look into Crossroads because when I finally get my truck fixed I am going to get rid of it. Depending on if my injectors get fixed depends on what kind of new truck i'll be getting.
kfowler05 01-22-2005, 05:10 PM Loki nine were the green keys hard to install on your truck cause I just got mine in and was wondering if I can install them or should i take it somewhere?

But if my warranty isnt voided how does the main branch of chevy know about it cause we had to call them and they said it was voided? Or is the dealership just feeding my bs again? As far as I know GMVIS is the only service related record GM keeps on your vehicle. I suspect BS.

kfowler05 01-23-2005, 01:36 AM So which one told them that I had it programmed? I'm guessing that it was the fuel pressure and could that be a reason for my injectors cracking? The last code you ran was supposed to be P7093, you put down P1093, are they the same code?

The last code you ran was supposed to be P7093, you put down P1093, are they the same code?Nothing tells them it was programmed. There is no p7093, I suspect you have a typo. P1093 is the common code indicating excessive return flow from the injectors.
kfowler05 01-23-2005, 05:42 PM Alrite thanks a lot, I've already talked to the service manager at Molle because he is a friend of my cousin and he said they would fix it.
