RUMAXED 07-15-2004, 07:37 PM yes i was taking a right hand turn, when this guy ran out in front of me, had to slam on the brakes. thank god i was able to stop. anyway he thinks this was funny, and says i can go........SO I DID with about 30 foot exhaust cloud. how i think it was funny........OOPPSS there was also a cop on that corner. yes he came after me, pulls me over. and says what with the 30 foot strip in the road. i tell him IT'A DIESEL IT IS GOING TO SMOKE A LITTLE http://www.dieselplace.com/forum/smileys/HiHi.gif

I'd imagine they have an excessive smoke check box in a DMV Faulty Equipment citation,if it was just the smoke .
Send you to Inspection with or without a fine. I guess I'd have to go D O T considering I'm commercial ay 11400,easy to beat.I'd just bring it to the dealer ,cops say I have faulty injectors.

Cops can give you reckless without reason. Then you are guilty until you choose to either pay the lawyer fine or the ticket and insurance fine. I personally think POS cops should be punished severly for giving tickets that don't stick. One good lawyer and the damn cop won't be so ticket happy.

Is that STATE law or County law where you are?

I'm sure that police officer pulled you over knowing he would serve you a warning, maybe just to check and see what you were running. Ya never know, he may have a DMAX himself.

It is state law not county in Florida & no I am not speaking in the intrest of the troopers some of them I will say are very strict. I am speaking on behalf of me a Deputy Sherrif.
As far as giving someone a reckless citation for no reason, I don't know, but the only way to write a citation is if an offense is committed. Otherwise take it to court & let the judge decide if it is valid or not. I don't know about elsewhere but reckless is a criminal citation and you could go to jail here.
Also if your engine is tuned correctly it should not be putting out clouds of smoke. The only time I would pull for this if it puts out so much smoke (insect control) that it causes a traffic hazard behind them and people can not see, very rare maybe 2 times in 7 years.
I will also agree that since the inspections left there are a lot more junkers on the road.
One last piece of advice to all, HONESTY, it goes a long way and is your best bet when dealing with the popo and you might even get out scott free.

hdmax 07-17-2004, 09:51 PM If you are 100% sure you are getting screwed over on a traffic ticket, you can demand a jury trial here in Ohio. If the Officer knows you are in the right, it will never go to trial.
But before you become a jerk remember all the hundreds of times that you broke the traffic laws and did not get caught.
I have never been pulled over for anything other then what I was being accused of, and nearly every time I have been let go with a warning.
